Safaris is an Consult & Travel agency for Kenya, Tanzania and Uganda holidays only.The rates
are guaranteed by the agency and are the efforts of personal agreements
with the hotelkeepers and facilities providers.
Art 1
Booking conditions
A booking
can be confirmed per email , postmail or telephone.The
traveller is aware of the conditions and the general information
considdering the trip within Kenya or and Tanzania and is aware of the
adventurous character of the trip and the local circumstances .The
agency and the agents will at all time take notice of the clients
preferences to the facilities but will not be responsible if the request
is not complied with.
Accommodations
Prices
are based on double occupany. On single bookings there is a supplement
for lodges and hotels. Accommodation are listed in preferred sequences.
They range from modern hotels in Nairobi, picturesque roundavels, deluxe
resort complexes, hotels charlets and permanent camps on safari circuits
to imaginatively designed beach hotels. Most have private bathrooms and
swimming pools and all have full restaurant and bar facilities.
Art.2
Alteration of the tour
The
sequense and accommodation of all itineraries is normally adhered to but
we reserve the right to make alterations enforced by weather, roadworks,
high season congestion or other cause
Art. 3
Liability of S'Harity Safaris
a) is not
liable for client additional expenses occasioned by their delay,
alteration of travel services, sickness, injuries, death, or as a result
of wheater, civil disturbances, war, quarantine, or any other
circumstances. Whatsoever interfering with, interrupting, altering or
adding to the cost of services, excursions or tours applied for and
booked.
b)The
company liability to passengers carried in vehicles used for transfers,
excursions and tours is covered by the law of Kenya/ Tanzania all claims
are subjected only to the courts of both countries.
c) The
company reserves the rights to employ sub- contractors and in the event
of such exercise of rights the forms of clause (a) relating to the
company's liability shall apply.
d) Whilst
every care is taken , the company cannot be responsible for loss or
damage of personal property and it is advisable to arrange relevant
insurance.
e)
All expeditions and andventure safari i.e campingsafaris , foot, camel,
canoe, dhow, falconry, horseback and crocodile catching safaris involve
an element of personal risk and can at times be of harzadous risk in
full. The company cannot accept any responsibility for personal
accidents or sichness as a result of clients participating in these
safaris. Personal Accident insurance is available on request from
Insurance Companies.
In case
of overbooking, or any complaint concerning the accommodation or safari
please contact the office in Nairobi or Arusha or the representative on
duty. They will give it their best efforts to clearify the situation
with you.
Art. 4
Prices
These
include all expenses connected with vehicle / boat and driver/ guide
sightseeing as indicated in itineraries . Entrance fees to attractions
visited, accommodations, service charges, government taxes, breakfast
while in Nairobi and full board on safari. Prices exclude the cost of
passport, visa, health documents, gratuities, laundry, drinks and other
personal items. Kenya Departure Tax is not included. All prices are
subject to change without advance notice based on included rates and or
fluctuations in foreign currency and all prices.
Art. 5
Luggage
Safari
orientations: Safaris tours are ideal for the good natured realist who
enjoys being with others and is able to adhere to the very modest
rigours imposed by a scheduled itinerary. Be prepared to sometimes
encounter customs, habits and living standards which may be different
from your own with an open tolerant mind. Local people in the towns and
country respond warmly to an attitude of friendship and respect and the
use of common courtesy at all times help to avoid misunderstanding. The
company reserves the right to decline accept or retain any person as a
member of any tour at any time in which case an equitable amount will be
refunded.
Art. 6
Payment and cancellation
a deposit
of 10 % is required but not demanded. The amount has to be paid 6 weeks
before arrival to the account of S'harity Safaris. After
receiving your payment a receipt will be sent to you.
Another
option is to pay the balance at arrival at our offices in cheques or
cash dollars/ euro's.
Paymens
with visa cards on request. Full details will be send once booking is
confirmed.
Art. 7
Hotel and safari cancellation
In case
of cancellation till 56 days before arrival there is a penalty charge of
50 USD required.
Within 56
till 42 days before arrival 10 % of the cost. Within 42 days till 28
days before arrival 50 % and 28 days till 14 days of arrival 75 % .
Within 14 days before arrival
100% of the cost.
Private
safaris are quoted depending on the number of participants. If one or
more participants cancel thier trip the total cost of the safari will be
requoted. We will charge the usual cost of the cancallations to those
who withdraw the safari confirming the mentioned conditions for safaris

8 Cancellation by the company S'harity Safaris
S'harity
Safaris has the right to cancel the trip in case of any of the
circumstances mentioned in Art.
3.
S'hairty
Safaris is not responsible for the cost made for visa, vaccinations or
insurances in case of cancellations
by the company.
S'harity
Safaris has the right to change the itinerary, schedule,
destination of arrival and departure or
even ending the trip due to circumstances mentioned in art. 3.
The
company is not responsible for the extra expenses made by the client in
case of cancellation due to
circumstances mentioned in art. 3.
Art.
9 Travel insurance and documents
The
traveller must have a valid passport, the requested vaccinations if
obligated, and visa if the trip is being
continued to Tanzania. In case of negligence of the client, all extra
expenses are the responsibilty of
the client. It is
recommended to have an travel insurance.
Art.
10 Travel policy
If a
traveller is leaving the group and continues his trip individual all
charges are for his account,there will be no restitution of the parts
not participated.
If a
traveller is in such matter misbehaving that it affects the quality of
the trip, the company has the right to
refuse further participation. All extra expenses made are to the account
of the clients.
If a
traveller is involved in serious problems the company is obligated to
assist the client witht the best efforts.
The expenses made are for the account of the client.
Art.
11 Complains
Any
complain considdering the travel agreement should be handed over to the
office in Nairobi or Arusha in written. If the complaint is not solved
to the satisfaction of the client, the traveller should within one month
send the complaint in written to S'Harity Safaris. At least
one month after receiving the complaint the company will reply to the
client.
Only the
KENYAN AND TANZANIAN laws are qualified to take aknowledge of the
transactions between the traveller and S'Harity safaris .Complaints should be reported within 3 months after
returning to the home country of the traveller.
